This article revisits the manuscript tradition and the different redactions of John Buridan’s commentaries on Aristotle’s Physics. The aim of the article is threefold. First, it makes some corrections to the lists of manuscripts containing the third redaction and the final redaction of Buridan’s questions commentary on the Physics. Second, it argues that manuscript Zaragoza, Biblioteca Capitular de la Seo, cod. 15-61, ff. 1r-62v, contains a previously unknown version of the final redaction (together with the standard version from f. 62v (...) onwards). Third, to facilitate further study of the manuscripts of Buridan’s questions on the Physics and their mutual relations, appendices at the end of the article provide detailed tables of contents for the third redaction and the final redaction, as well as editions of selected questions from the Zaragoza manuscript, the third redaction of Buridan’s questions on the Physics, and the so-called Quaestiones breves. In most areas of our lives, legal protections are in place to ensure that we have autonomous control over what happens in and to our bodies. However, there are fewer protections in place for autonomous choice when it comes to the food we purchase and consume. In fact, the current trend in US legislation is pushing us away from autonomous food choice. In this paper, I discuss two examples of this trend: corporate resistance to GM labeling laws and farm protection (...) laws. These examples are quite different from a legislative point of view. In one case, laws that would promote autonomous choice are actively resisted, whereas in the other case, laws that undermine autonomy are enacted. The common core of the two examples is the effect: in both cases, we are unable to determine whether the food we purchase and consume is consistent with our values. In both cases, then, autonomous choice about the food we purchase and put into our bodies is undermined. (shrink)

This paper elaborates on conceptual, empirical and practical arguments why corporations need to focus on their social dimensions, in order to further enhance organizational performance. The paper starts with an introduction on the general trend towards inclusiveness and connectedness. It then elaborates on the phase-wise development of cultures and organizational structures. Managing corporate improvement by building cultures of trust is the central focus of this contribution. By showing the cultural dimensions of Great Places to Work and their workplace practices, worthwhile (...) experiences leading to organizational improvement and superior financial performance are demonstrated. International legal scholars tend to think of their work as the interpretation of rules: the application of a law 'out there' to concrete situations. This book takes a different approach to that scholarship: it views doctrine as a socio-linguistic practice. In other words, this book views legal scholars not as law-appliers, but as constructing knowledge within a particular academic discipline. By means of three close-ups of the discourse on cyberwar and international law, this book shows how international legal knowledge is (...) constructed in ways usually overlooked: by means of footnotes, for example, or conference presentations. In so doing, this book aims to present a new way of seeing international legal scholarship: one that pays attention to the mundane parts of international legal texts and provides a different understanding of how international law as we know it comes about. Certain organoid subtypes are particularly sensitive. We explore whether moral intuitions about the heartbeat warrant unique moral consideration for newly advanced contracting cardiac organoids. Despite the heartbeat’s moral significance in organ procurement and abortion discussions, we argue that this significance should not translate into moral implications for cardiac organoids.

The replicability and importance of the correlation between cognitive style and religious belief have been debated. Moreover, the literature has not examined distinct psychological accounts of this relationship. We tested the replicability of the correlation (N = 5284; students and broader samples of Canadians, Americans, and Indians); while testing three accounts of how cognitive style comes to be related to belief in God, karma, witchcraft, and to the belief that religion is necessary for morality. The first, the dual process model, (...) posits that analytical thinking is recruited in overriding intuitions related to supernatural beliefs. The second, the expressive rationality model, posits that analytical thinking is recruited in supporting already-held beliefs in an identity-protective manner. And the third, the counter-normativity rationality model, posits that analytical thinking is recruited to question beliefs supported by prevailing cultural norms. In Study 2, we tested the replicability of our results in a re-analysis of published data. The association between analytic thinking style and beliefs was replicated. We conclude that whereas the counter-normativity rationality model was contradicted by the data, both the dual process and expressive rationality models received varying degrees of empirical support, but neither model fully accounted for all the patterns in the data. This unique publication outlines the development of legal theory from pre-Roman times to the twentieth century. It aims to relate the evolution of legal theory to parallel developments in political history, and accordingly offers the reader an account of relevant contemporaneous political, religious, and economic events. Each chapter commences with a general historical background for the relevant period, and discusses how political events and political and legal theory are both related to one another and occasionally influence one another.No other English (...) publication aims to anchor legal theory to contemporary general history in this way, shunning the more conventional approach to legal theory via the study of 'traditions' or 'schools', and it is hoped that this study will provide a much-needed basic text for students of jurisprudence, legal theory and politics. Modern medicine provides unprecedented opportunities in diagnostics and treatment. However, in some situations at the end of a patient’s life, many physicians refrain from using all possible measures to prolong life. We studied the incidence of different types of treatment withheld or withdrawn in 6 European countries and analyzed the main background characteristics.

Upshot: This commentary aims to sharpen the conceptual distinction between the breadth and the depth of dream experience. I discuss several possible readings and argue that the best one construes breadth and depth as distinct but complimentary research strategies distinguished not just by the kinds of evidence they rely on, but also by the (...) degree to which different types of data are integrated and focused on the same experiential episode. Heuristics of evolutionary biology dictate that phylogenetically older processes are inherently more stable and resilient to disruption than younger processes. On the grounds that non-declarative behaviour emerged long before declarative behaviour, Reber argues that implicit learning is supported by neural processes that are evolutionarily older than those supporting explicit learning. Reber suggested that implicit learning thus leads to performance that is more robust than explicit learning. Applying this evolutionary framework to motor performance, we examined whether implicit motor learning, relative to (...) explicit motor learning, conferred motor output that was resilient to physiological fatigue and durable over time. In Part One of the study a fatigued state was induced by a double Wingate Anaerobic test protocol. Fatigue had no affect on performance of participants in the implicit condition; whereas, performance of participants in the explicit condition deteriorated significantly. In Part Two of the study a convenience sample of participants was recalled following a one-year hiatus. In both the implicit and the explicit condition retention of performance was seen and, contrary to the findings in Part One, so was resilience to fatigue. The resilient performance in the explicit condition after one year may have resulted from forgetting or from consolidation of declarative knowledge as implicit memories. In either case, implicit processes were left to more effectively support motor performance. (shrink)

In this introduction I give an overview of Carole Hafner’s work and discuss the papers in this volume. The final section offers some more personal reminiscences of Carole and her contribution to the AI and Law community, from myself and other colleagues.

Decentralized clinical trials (DCTs) have the potential to advance the conduct of clinical trials, but raise several ethical issues, including obtaining valid informed consent. The debate on the ethical issues resulting from digitalization is predominantly focused on direct risks relating to for example data protection, safety, and data quality. We submit however, that a broader view on ethical aspects of DCTs is needed to touch upon the new challenges that come with the DCT practice. Digitalization has impacts that go beyond (...) its direct purposes, by shaping behaviors, experiences, social relations, and values. We examine four elements of the informed consent procedure that are affected by DCTs, while taking these soft impacts of technologies into account: (i) informing participants and testing understanding, (ii) freedoms in relation to responsibilities and burdens, (iii) trust in participant-researcher relations, and (iv) impacts on the concept of privacy. Our analysis reveals that a broad view is key for optimal conduct of DCTs. In addition, it provides insight into the ethical impacts of DCTs on informed consent. Technologies such as DCTs potentially have profound impacts which are not immediately addressed by the existing regulatory frameworks, but nonetheless important to recognize. These findings can guide future practices of DCTs to foster the important values of clinical research in this novel approach for conducting clinical trials. (shrink)

Ibn Rushd (1126-1198), or Averroes, is widely known as the unrivalled commentator on virtually all works by Aristotle. His commentaries and treatises were used as manuals for understanding Aristotelian philosophy until the Age of the Enlightenment. Both Averroes and the movement commonly known as 'Latin Averroism' have attracted considerable attention from historians of philosophy and science. Whereas most studies focus on Averroes' psychology, particularly on his doctrine of the 'unity of the intellect', Averroes' natural philosophy as a whole and its (...) influence still remain largely unexplored. This volume aims to fill the gap by studying various aspects of Averroes' natural philosophical thought, in order to evaluate its impact on the history of philosophy and science between the late Middle Ages and the Early Modern Period. This article offers a detailed presentation of three anonymous, unedited sets of questions on Aristotle’s Physics. The commentaries survive in manuscripts in Oxford, Munich and Sint Agatha. A comparison of the lists of quaestiones suggests that there is a close correspondence between the three commentaries, on the one hand, and the ultima lectura of John Buridan’s Quaestiones super octo libros Physicorum, on the other. Judging from the lists of quaestiones, it makes sense to attach the label secundum Buridanum to all (...) three commentaries. However, the texts of the three commentaries differ significantly both from each other and from Buridan’s lecture. To illustrate the differences, in the Appendix I present editions of one question from Book I of the Physics and one question from Book III from each of the three commentaries. Pediatric biobanking is considered important for generating biomedical knowledge and improving health care. However, the inclusion of children’s samples in biobanks involves specific ethical issues. One of the main concerns is how to appropriately engage children in the consent procedure. We suggest that children should be involved through a personalized assent procedure, which means that both the content and the process of assent are adjusted to the individual child. In this paper we provide guidance on how to put personalized assent (...) into pediatric biobanking practice and consider both the content and process of personalized assent. In the discussion we argue that the assent procedure itself is formative. Investing in the procedure should be a requirement for pediatric biobank research. Although personalized assent will require certain efforts, the pediatric community must be aware of its importance. The investment and trust earned can result in ongoing engagement, important longitudinal information, and stability in/for the research infrastructure, as well as increased knowledge among its participants about research activity. Implementing personalized assent will both respect the child and support biobank research. (shrink)

Task unrelated thought (TUT) refers to thought directed away from the current situation, for example a daydream. Three experiments were conducted on healthy participants, with two broad aims. First, to contrast distributed and encapsulated views of cognition by comparing the encoding of categorical and random lists of words (Experiments One and Two). Second, to examine the consequences of experiencing TUT during study on the subsequent retrieval of information (Experiments One, Two, and Three). Experiments One and Two demonstrated lower levels of (...) TUT and higher levels of word-fragment completion whilst encoding categorical relative to random stimuli, supporting the role of a distributed resource in the maintenance of TUT. In addition the results of all three experiments suggested that experiencing TUT during study had a measurable effect on subsequent retrieval. TUT was associated with increased frequency of false alarms at retrieval (Experiment One). In the subsequent experiments TUT was associated with no advantage to retrieval based on recollection, by manipulating instructions at encoding (Experiment Two), and/or at retrieval (Experiment Three). The implications of the results of all three experiments are discussed in terms of recent accounts of memory retrieval and conscious awareness. (shrink)

In “Hegel’s Phenomenological Method,” Kenley R. Dove maintains that the method of the Phenomenology of Spirit is not dialectical but instead wholly phenomenological. That is, Dove claims that Hegel’s method is purely descriptive. Dove’s interpretation has been highly influential and widely accepted. This article argues that, although there is a phenomenological aspect to Hegel’s method, that aspect itself presupposes a prior dialectical moment. Failure to account for that dialectical moment results in spirit being reduced to substance.
